Title
APPROVING CHANGE ORDER NO. 3 IN THE AMOUNT OF $7,049.06, CHANGE ORDER NO. 4 IN THE AMOUNT OF $17,647.20, AND CHANGE ORDER NO. 5 IN THE AMOUNT OF $61,317.40 TO THE MARGATE BOULEVARD CROSSWALK AND LANDSCAPE IMPROVEMENTS PROJECT AGREEMENT WITH FG CONSTRUCTION, LLC. AND PROVIDE FOR AN INCREASE IN CONTRACT TIME FOR AN ADDITIONAL 14 DAYS; AUTHORIZING THE BOARD CHAIR TO EXECUTE THE CHANGE ORDERS
BACKGROUND: In July 2021 the MCRA engaged the services of Chen Moore & Associates, Inc. (CMA) to provide professional civil engineering, planning and landscape architecture services for the design, permitting, and construction administration needed for the Margate Boulevard Crosswalk and Landscape Improvements project.
The project scope includes the sidewalk and crosswalk reconstruction to conform to ADA standards, landscaping improvements including irrigation and energy efficient lighting, improvements of existing stormwater drainage conflict within project limits, and road resurfacing. The project is confined to the right-of way along Margate Boulevard from US 441 to East River Drive and N.W. 58th Avenue from Park drive to approximately one-half (1/2) block northeast of Margate Boulevard.
In May 2025 the Board approved an agreement with FG Construction LLC in the amount of $1,004,788.71. Construction started on August 14, 2025 with a final completion date set for April 11, 2026. At the January 14, 2026 MCRA meeting the Board approved Change Orders No. 1 and 2 totaling $37,012.49, increasing the contract total to $1,041,801.20 and added an additional 21 days bringing the completion date to May 2, 2026.
Change Order No. 3 provides for the restoration of the intersection of East River Drive and Margate Boulevard where the existing asphalt is showing signs of distress. This will add additional milling and resurfacing to the project as well as replacement thermoplastic pavement markings in the amount of $7,049.06.
Change Order No. 4 includes modification to the driveway located between Ramps 5 and 6, as identified in the MCRA Margate Blvd plans, to address cross slopes exceeding 2% and high points in the gutter for proper drainage in the amount of $17,647.20.
Change Order No. 5 addresses an evident depression in the right-turn lane prior to turning onto US 441. While solely impacting the right turning lane, there are cracks in the adjacent lanes that are stemming from the depression area. To correct this, it is proposed to excavate the area surrounding the depression and install approved material and compact to specifications. Milling and resurfacing of Margate Boulevard is already a part of the project scope and will be completed once all drainage, restoration and landscaping work is finalized. This change order is in the amount of $61,317.40.
Change Order No. 3, 4 and 5 increase the contract time by 2, 7 and 5 calendar days (14 days total), respectively. Current contract final completion date is May 2, 2026. If Change Orders No. 3, 4 and 5 are approved the final completion date for the contract would be May 16, 2026.
RECOMMENDATION: For review and approval
FISCAL IMPACT: $7,049.06 for Change Order No. 3, $17,647.20 for Change Order No. 4 and $61,317.40 for Change Order No. 5 (Total requested $86,013.66). The project is being funded under the approved Margate Boulevard Improvements budget line of the Capital Improvements Program Fund; A/C 340.0510.563056.
