APPROVAL OF A TEMPORARY USE AGREEMENT BETWEEN THE MCRA AND HILDEBRAND AMUSEMENT RIDES, INC., FOR THE USE OF MCRA PROPERTY AT 1000 NORTH STATE ROAD 7 TO HOLD A MARGATE SPRING FLING

BACKGROUND:                     Joshua Rydell, on behalf of Hildebrand Amusement Rides, Inc., submitted a Special Events Application and a Temporary Use Agreement for use of the MCRA property located at 1000 North State Road 7 to hold a Margate Spring Fling.   Except for the inclusion of a circus in this application, the remaining elements of the request are consistent with that of the 2024 Margate Spring Break Fair and The Fair at Margate held in Spring and Fall of last year. 

 

The applicant is requesting use of the property from March 3, 2025 through April 7, 2025 (total 36 days).  The property would be used as follows:                      

                     March 3 through March 13: Event set-up (11 days)

                     March 14 through March 30: Operation of the Spring Fling (17 days)

                     March 31 through April 7: Event breakdown (8 days)

 

The request is to operate the Spring Fling during the following hours:

                     Monday through Thursday: 5 p.m. to 11 p.m.

                     Friday: 5 p.m. to 1 a.m.

                     Saturday: 2 p.m. to 1 a.m.

                     Sunday: 2 p.m. to 11 p.m.

 

The Spring Fling would include amusement park rides, kiddie rides, bounce house/inflatables, food vendors, arts and crafts vendors, live entertainment and a circus.  The use of the stage is requested and the estimated attendance is 15,000 total for the event.  It should be noted that Hildebrand have an outstanding amount of $157,784.50 still due for The Fair at Margate.

 

If the Board approves the use of MCRA property to hold the event, the request will also need to go through the City’s Temporary Use Permit (TUP) process and go before the City Commission for approval due to the length of the event and hours of operation.   City Code Section 3.24 - Temporary Use Permits limits such events to no more than 21 consecutive days (the request is for 36 days); the City Code requires event closure at 10:00 p.m. every night (the request is for 11 p.m. Sunday through Thursday; and 1 a.m. on Friday and Saturday).  Use of the City stage is also requested which requires City approval.

 

Hildebrand Amusement Rides, Inc., and amusement rides vendor will also be required to provide the required general liability insurance and indemnification.  

 

RECOMMENDATION:                     For Board discussion and direction.  If the MCRA Board wishes to grant use of the property, the item will need to go before the City Commission for approval as part of the City’s TUP process, and for approval of the extended length of the event and hours of operation. 

 

 

FISCAL IMPACT:                     The Temporary Use Agreement submitted by Hildebrand Amusement Rides, Inc., indicates a rental payment of $25,000 for use of the property would be made to the MCRA; $15,000 will be paid on March 14, 2025  and $10,000 will be paid on March 24, 2025.
