RESOLUTION - APPROVING THE 2025 AMENDED AND RESTATED TRANSPORTATION SYSTEM SURTAX INTERLOCAL AGREEMENT WITH BROWARD COUNTY, THE METROPOLITAN PLANNING ORGANIZATION (MPO), AND PARTICIPATING MUNICIPALITIES; PROVIDING FOR ALLOCATIONS; PROVIDING FOR REPRIORITIZING FUNDING TO COMMUNITY SHUTTLE, CAPITAL PROJECTS, AND REHABILITATION AND MAINTENANCE (R&M) PROJECTS; PROVIDING FOR NEW FORMULA-BASED FUNDING MODEL FOR R&M PROJECTS AND ON-DEMAND TRANSPORTATION PROJECTS; PROVIDING FOR LOCAL MATCH OPTION IN RELATION TO STATE AND FEDERAL APPROPRIATIONS AND GRANTS; PROVIDING FOR JOINT MANAGEMENT OF COMMUNITY SHUTTLE PROGRAMS; PROVIDING FOR ROLE OF THE BROWARD CITY COUNTY MANAGERS ASSOCIATION; PROVIDING FOR AN EFFECTIVE DATE .
BACKGROUND:
On June 5, 2018, the Broward County Board of County Commissioners enacted Broward County Ordinance No. 2018-29, the Broward County Surtax Ordinance, which, among other things, provides a process by which any municipality within Broward County may apply for project funding from surtax proceeds. Funding of submitted municipal projects is accomplished through interlocal agreements between the County and the applicable Municipalities. On November 8, 2018, County and Municipalities entered into a Transportation Surtax Interlocal Agreement that addressed the distribution of proceeds of the Transportation Surtax. The Original ILA was amended in June 2019 (“First Amendment”), and in March 2021 (“Second Amendment”), further defining the relationship between the parties and adding the MPO as a party for purposes of the evaluation and ranking of certain capital projects for potential Transportation Surtax funding.
This Third Amendment restates the ILA and provides for the following:
• Status of the remaining Cycle 1 Projects and the ability of County to terminate such projects that are not under a Surtax Funding Agreement
• Reprioritize the funding to Community Shuttle, Capital Projects, and Rehabilitation and Maintenance (R&M) Projects
• Formula-based Funding model for R&M Projects and On-Demand Transportation during Fiscal Years 2026 to 2032
• Create a new means of allowing Municipalities the ability to obtain Transportation Surtax funding to be used as required local match in relation to state and federal appropriations and grants
• Streamline the manner by which projects funded by the Transportation Surtax are placed under Surtax Funding Agreements
• Provide Municipalities with flexibility on how each will use Formula-based Funding from the Transportation Surtax
• Permit multiple Municipalities to collaborate on the joint management of their Community Shuttle programs
• Permit the ILA to be more easily modified, if and as required, to more efficiently and effectively distribute the Transportation Surtax Proceeds committed to Municipalities
• Describe the role of BCCMA
