Title
AN ORDINANCE OF THE CITY OF MARGATE, FLORIDA, AMENDING CHAPTER 2 - ADMINISTRATION, ARTICLE II - FINANCES, SECTION 2-23 PURPOSE AND INTENT, SECTION 2-24 - DEFINITIONS, SECTION 2-25 - PURCHASING PROCEDURES, SECTION 2-26 PURCHASING RESTRICTIONS; WHEN BIDS REQUESTS FOR PROPOSALS OR LETTERS OF INTEREST REQUIRED, SECTION 2-27 CONTRACTS FOR CONSTRUCTION OF PUBLIC WORKS AND IMPROVEMENTS, AND SECTION 2-28 AWARD OF BIDS, REQUESTS FOR PROPOSALS, LETTERS OF INTEREST, AND OTHER SOLICITATIONS; PROCEDURE FOR LETTING; PROVIDING FOR CLARIFYING DEFINITIONS OF PIGGYBACKING, FORMAL QUOTE, AND INFORMAL QUOTE; AMENDING THE THRESHOLDS FOR PURCHASING AUTHORITY; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE
BACKGROUND:
The last significant update to the City’s purchasing code was adopted nearly a decade ago in 2017. This proposed ordinance updates the code to incorporate definitions consistent with current purchasing policies, procedures, and practices, provides for threshold limit adjustments that are more consistent with those adopted by other local governmental agencies and are more in line with current economic factors. Additionally, a change in our bond requirement threshold is recommended to establish consistency with State statutes for bond waiver provisions.
Recommended changes to the City’s purchasing code, policies, and procedures that are incorporated into this proposed ordinance are:
1. Updates Sec. 2-23 to more clearly establish parameters for cooperative bidding, piggybacking from an existing agreement and/or direct purchase involving special districts, other governmental agencies, or educational institutions.
2. Updates Sec. 2-24 to include definitions for formal quote, informal quote, and piggybacking.
3. Updates Sec. 2-25 to provide for changes to the current $50,000 threshold for advanced formal solicitation notification requirements and award authorizations to $100,000 for both.
4. Updates Sec. 2-26 to provide for changes to currently established thresholds.
Current:
Up to $3,500 approved by Department Director or designee
Over $3,500 up to $10,000 three informal quotes
Over $10,000 up to $25,000 three formal quotes
over $25,000 written sealed bids or request for proposals or other solicitations
Proposed:
Up to $5,000 approved by Department Director or designee with one informal quote
Over $5,000 up to $25,000 three informal quotes
Over $25,000 up to $50,000 three formal quotes
over $50,000 written sealed bids or request for proposals or other formal solicitations
5. Updates Sec. 2-27 to provide for a threshold of $200,000, or less, project cost when requirements for bonds may be waived. Providing for consistency with Section 255.05(d), Fla.Stat., as may be amended from time to time.
6. Updates Sec. 2-28 to provide for changes to the formal solicitation award requirement thresholds currently set at (1) $50,000 or less and (2) excess of $50,000 to (1) $100,000 or less and (2) excess of $100,000.
