THE FAIR AT MARGATE SPONSORED BY HILDEBRAND AMUSEMENT RIDES, INC.

BACKGROUND: Hildebrand Amusement Rides, Inc. is requesting preliminary approval to use six MCRA owned properties to hold The Fair at Margate from November 10, 2023 through December 10, 2023 (31 days). The main operation of the Fair will take place at 1000 North State Road 7 (former Swap Shop) and the other five parcels will be for parking. The properties being requested are identified in Exhibit A of the attached Temporary Use Agreement.
The Fair at Margate is requesting use of the properties for 31 days as follows:
• November 10 through November 16 (7 days) for event set-up
• November 17 through December 3 (17 days) for event operations
• December 4 through 10 (7 days) for event take-down
The request is to operate the Fair during the following hours:
• Monday through Thursday: 5 p.m. to midnight
• Friday: 5 p.m. to 1:00 a.m.
• Saturdays: 1 p.m. to 1:00 a.m.
• Sundays: 1 p.m. to midnight
The Fair would include the following features: Food vendors; arts & crafts vendors; other product vendors; live entertainment; amusement park rides; kiddie rides; bounce house; inflatables; motorized sports; special acts; animal displays and educational displays. Estimated attendance is 50,000 attendees.
The Development Agreement that exists between the MCRA and New Urban Communities prohibits the utilization of the property at 1000 North State Road 7 for carnivals or fairs. The event sponsor is aware that the Developer’s approval is a requisite to hold the Fair on the requested MCRA property.
At this time, the requestor, Hildebrand Amusement Rides, Inc., is seeking approval from the MCRA Board to hold the Fair. If the Board approves the Temporary Use Agreement, this request will also need to go through the Temporary Use Permit process and go before the City Commission for approval due to the length of the event and the hours of operation. City Code limits such events to no more than 21 consecutive calendar days (the request is for 31 days); City Code requires event closure at 10:00 p.m. (the request is for midnight during the week and Sundays and 1:00 a.m. on Friday and Saturday).
RECOMMENDATION: For Board review and direction.
FISCAL IMPACT: The preliminary Temporary Use Agreement submitted by Hildebrand Amusement Rides indicates that a rental payment of $50,000 for use of the property would be made to the MCRA; $25,000 will be paid on November 10, 2023 and $25,000 will be paid on December 3, 2023.
