BACKGROUND:                     Upon the City staff’s review of the relevant documentation related to whether the City has any legal obligation to maintain the stormwater facilities within the Oriole Golf & Tennis Club Phase One (the “Association”) property, and several internal discussions, staff cannot find any formal acceptance of the stormwater facilities by the City.  For the City to have taken ownership and control of the facilities there would have been some action taken by the City Commission to accept responsibility, including a bill of sale/conveyance document from either the developer or the Association.  In addition, there is no record of any easements providing the City with legal access to the facilities.  Absent any formal action of acceptance, and any other relevant documentation, the City has no jurisdiction or obligation to maintain the stormwater facilities within the Oriole Golf & Tennis Club Phase One property.

 

While the City did accept the conveyance of the “road right-of-way,” the conveyance of the “road right-of-way” only relates to the road itself and not any utilities lying beneath the road right-of-way.  Furthermore, Section 12.2 of the Association’s Declaration of Covenants and Restrictions also clarifies that the dedication to the City was only for road purposes. There is no reference to any other dedication to the City.

 

This License Agreement will allow the Public Works Department Stormwater Division access to maintain the inlets in a manner that is consistent with current standard operating procedures.
