RESOLUTION - EXPRESSING STRONG OPPOSITION TO SENATE BILL 1242 AND HOUSE BILL 991 THAT SEEK TO ELIMINATE COMMUNITY REDEVELOPMENT AGENCIES; URGING ALL MEMBERS OF THE FLORIDA LEGISLATURE TO OPPOSE SENATE BILL 1242 AND HOUSE BILL 991 THAT WOULD RESTRICT OR ELIMINATE COMMUNITY REDEVELOPMENT AGENCIES; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE FLORIDA LEAGUE OF CITIES; THE BROWARD COUNTY LEGISLATIVE DELEGATION AND ANY OTHER INTERESTED PARTIES; PROVIDING FOR AN EFFECTIVE DATE.
BACKGROUND: This agenda item is to provide for the City Commission to oppose Senate Bill (SB) 1242 and House Bill (HB) 991 relating to Community Redevelopment Agencies (CRA). These bills would prohibit CRAs from starting any new projects or issuing any new debt on or after October 1, 2025. These bills also provide for termination of all Florida CRAs on September 30, 2045, or at the date of the expiration of the CRA.
The Margate CRA is scheduled to sunset in August of 2026; however, the MCRA still has significant work to complete including the City Center Project. Based on current Florida law, the MCRA is statutorily eligible to extend the MCRA to 2047, which is 30 years after the date the governing board amended the plan. A request to extend the MCRA sunset date is currently under review by Broward County.
These Bills would significantly hamper the Margate CRA’s ability to complete its mission to create and develop a mixed-use City Center that brings in new business, creates new living opportunities, and supports our local community.
RECOMMENDATION: For approval.
