BACKGROUND:

PHASE II OF THE CODE UPDATE PROJECT:
The City of Margate has contracted services with Calvin, Giordano & Associates, Inc. (CGA) for a code update. The focus of this project is to update the City's land development regulations and zoning code. The project is split into phases. This ordinance represents phase II of the project and consists of edits to the following code areas:

Amending Chapter 40 - "Land Development Code"
Repealing Chapter 23 - "Landscaping"
Repealing Appendix A - "Zoning"
Repealing Appendix C - "Land Development Code"

Phase I was approved on 07/05/2023. This document combines what was previously approved into one complete Chapter 40 - "Unified Land Development Code".

The Development Services Department (DSD) is overseeing this project and coordinating reviews with the Department of Environmental and Engineering Services (DEES), Building and Code Services Department, Public Works Department, parks and Recreation Department, City Attorney's Office, Police Department and Fire Department.

The Ordinance was approved on first reading with an amendment providing for an appeals process for variances related to distance separation that are approved by the Board of Adjustment that may be initiated by City Commissioners and /or aggrieved parties.
