Title
AN ORDINANCE OF THE CITY OF MARGATE, FLORIDA, AMENDING CHAPTER 2, "ADMINISTRATION," CHAPTER 11, "DRAINAGE AND WATERWAY STRUCTURES," AND CHAPTER 35, "STREETS, SIDEWALKS AND OTHER PUBLIC PLACES;" REPEALING CHAPTER 31, "PLATTING, SUBDIVISION AND OTHER LAND USE REGULATIONS;" CREATING CHAPTER 40 "LAND DEVELOPMENT CODE"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE.

Body

BACKGROUND: The City of Margate has contacted services with Calvin, Giordano & Associates, Inc. (CGA) for a code update. The focus of this project is to update the City's land development regulations and zoning code. The project is split into phases. This ordinance represents Phase 1 of the project and consists of edits to the following code areas:

Chapter 2 - Administration
Chapter 11 - Drainage and Waterway Structures
Chapter 17 - Floodplain Management
Chapter 31 - Platting, Subdivision and Other Land Use Regulations
Chapter 35 - Streets, Sidewalks and Other Public Places

The Development Services Department (DSD) is overseeing this project and coordinating reviews with the Department of Environmental and Engineering Services (DEES), Building and Code Services Department, Public Works Department, Parks and Recreation Department, City Attorney's Office, Police Department, and Fire Department.

After initial review and comment with CGA staff, the DEES department opted to proceed with updating Chapter 17 separately from Phase 1. This chapter was updated on July 14, 2021 through Ordinance 2021-8. DEES is currently working toward a second ordinance for this Chapter, thus it has been omitted from Phase 1 of the CGA project.

RECOMMENDATION: The Planning and Zoning Board recommended approval on June 6, 2023
