A RESOLUTION OF THE CITY OF MARGATE, FLORIDA, APPROVING REVOCABLE LICENSE AGREEMENT WITH BROWARD COUNTY AND TC MC MARGATE APARTMENTS, LLC AND ASSIGNS FOR THE MAINTENANCE OF LANDSCAPING AND RELATED IMPROVEMENTS WITHIN THE COCONUT CREEK PARKWAY SWALE ADJACENT TO 5205-5231 COCONUT CREEK PARKWAY; AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND:                                           This Resolution authorizes the Mayor and City Manager to execute a Revocable License Agreement (RLA) of behalf of the City of Margate, with Broward County and TC MC Margate Apartments, LLC, the owner of a multifamily development identified as Legacy of Margate, formerly identified as Marquesa, located at 5205-5231 Coconut Creek Parkway (Subject Property).  The RLA is meant to provide for the perpetual maintenance of improvements installed in the Coconut Creek Parkway right-of-way, adjacent to Subject Property, and binds all heirs and assigns of Subject Property.  The City’s land development regulations require new developments to include landscaping and irrigation improvements in the adjacent rights-of-way.  Coconut Creek Parkway is a Broward County right-of-way, and Broward County requires a tri-party RLA between the County, the City, and the property owner of the Subject Property for the maintenance of landscaping and irrigation improvements within the right-of-way.  This resolution is required before any certificates of occupancy may be issued, pursuant to Section 40.704(D)3. of the Margate Unified Land Development Code.
