BACKGROUND: The petitioner, Dunkin Donuts, proposes to construct drive-through facilities at its present location which it has operated as a walk-in only type business. Margate Code does not allow drive-through facilities in the B-1 Neighborhood Business zoning district. However, the use is allowed as a Special Exception in the B-2 Limited Business zoning district. It is proposed that the Code be amended to allow the use as a Special Exception in the B-1 district with the provision that such special exceptions would be limited to locations within a shopping center.
