ORDINANCE - AMENDING CHAPTER 1, “GENERAL PROVISIONS” OF THE CITY OF MARGATE CODE OF ORDINANCES; CLARIFYING THE AUTHORITY AND PROCEDURES TO ENFORCE THE CITY CODE; AMENDING CODE ENFORCEMENT PENALTIES; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE
BACKGROUND: Currently our Special Magistrate process require a penalty hearing. This proposed ordinance change will combine the violation hearing and penalty hearing, eliminating the need to hear a case twice. Most of the changes within this ordinance are the reorganization of the code sections for clarity and consistency with Chapter 162 of Florida Statutes. Changes made between the first and second reading are in shaded text.
A separate resolution will follow the reading of this ordinance to provide for Commission approval of the associated Special Magistrate Procedures.
RECOMMENDATION: City Staff recommends Approval.
FISCAL IMPACT: Cost savings to the city will be realized by reducing paperwork, eliminating duplicate work by Staff and reduced mailing costs.
