AMENDMENT TO TEMPORARY USE AGREEMENT FOR ST. VINCENT CHURCH FESTIVAL
BACKGROUND:
On May 13, 2015 the MCRA approved a temporary use agreement for St. Vincent Church allowing the use of the property at 1000 N. State Road 7 for their annual festival. The dates of the agreement were November 16th through December 6th, with the rides operating through December 3rd. Due to heavy rains during the weekend of November 20 - 22nd, the festival did not operate. The church is asking for permission to continue the festival through Wednesday December 9th in order to operate for an additional weekend. The rides and equipment will be removed between December 7th and 9th.
The CRA’s Event Policy states the following with regard to time extensions: “The CRA reserves the right by majority to extend the times of approved events for good cause. Fees associated with an extended event may be waived or adjusted based on good cause.” The fee charged for the original 15 days of operation (excluding set up and take down days) was $5,357.14, which represents $5,000.00 for the 14-day period plus $357.14 for the one additional day. Since the festival lost an entire weekend due to inclement weather, the Board may want to consider waiving the fees for the additional days (total of $1,071.42).
RECOMMENDATION:
Approve the Amendment extending the time frame for the St. Vincent Church Festival to December 9, 2015, and waive the requirement for additional fees.
FISCAL IMPACT: If fees are waived, the impact is $1,071.42 (3 days at $357.14 each)
