APPROVAL OF AGREEMENT WITH FRANK, WEINBERG & BLACK P.L. FOR LEGAL SERVICES ASSOCIATED WITH THE CITY CENTER PROJECT

BACKGROUND:
Responses to the RFP for the City Center project are due on May 12, 2015. We expect to receive two responses, and anticipate that negotiation of a development agreement with one or both firms will begin after the CRA's June meeting. Attached is a letter agreement with the legal firm Frank, Weinberg & Black, P.L., to represent the MCRA in the negotiations. FWP has represented the MCRA in previous negotiations - they have extensive experience in development contracts and have performed satisfactorily in the past. The hourly rate of the principal attorneys who will be involved, Edward Deutsch and Steven Deutsch, is $275/hour, which is less than their standard rate. Per the CRA's procurement guidelines, the total amount that will be paid for these services cannot exceed $25,000.
RECOMMENDATION:
Approve the agreement with Frank, Weinberg & Black P.L. for legal services associated with the City Center project.
FISCAL IMPACT: $275/hour, maximum cost: $25,000. Funding is available in the FY 15 Budget, Account 140-0510-512-31-01.
