RESOLUTION - VACATING, RELEASING, AND ABANDONING OF RIGHT-OF-WAY IN THE PALM BEACH FARMS COMPANY PLAT NO. 3; HSQ GROUP, INC., PETITIONER.

BACKGROUND:                                                                                      Many road rights-of-way in the City of Margate were granted in 1912 by the Palm Beach Farms Company Plat No. 3.  These rights-of-way were laid out in a very large grid pattern.  As the city developed, additional road rights-of-way were granted to allow for road construction in more strategic locations.  Coral Gate Boulevard was constructed less than 700 feet north of one of these 1912 rights-of-way.  As a result, when the surrounding area was developed in the 1980s, portions of the right-of-way were vacated in conjunction with that development since two roads were not needed in such close proximity of each other.  The remaining portion of this right-of-way is now land locked (please refer to sketch in background information).  Coral Gate Park is to the north of the remaining right-of-way and the Celebration Pointe North plat is to the south.  Celebration Pointe North has requested the southern half of the remaining right-of-way be vacated for use as additional buffer and open space.  Letters of no objection have been received from Florida Power and Light, Teco Peoples Gas, Comcast, and AT&T.  The Department of Environmental and Engineering Services also has no objection to the proposed vacation.
