AMENDING THE CODE OF THE CITY OF MARGATE, FLORIDA, APPENDIX A ZONING, ARTICLE XXXIX SIGN CODE, 39.7 TEMPORARY SIGNS AND ADDING NEW SECTION 39.20-SAVINGS CLAUSE; PROVIDING FOR CLARIFICATION OF ELECTION AND OPINION SIGNS.

BACKGROUND:                      The City Commission held two workshops on August 28, 2014 and October 2, 2014 to provide guidance on updating the entire sign code. On June 17, 2015, the City Commission approved the First Reading of the ordinance which included the recommendation of maximum display time of twelve (12) consecutive months for opinion and election signage. On July 1, 2015, the City Commission approved the sign code changes at Second Reading; however, the twelve month display provision was included in the agenda fact sheet but not in the ordinance document itself. Further clarification is also needed as to whether the intent for the twelve (12) month display was for one and two family dwelling districts only excluding multi-family residential.

 

A savings clause, which is typically included in the Section portion of all ordinances, and was included on all prior readings of the Sign Code amendment, has been added as part of Article XXXIX to provide for maintaining the validity of portions of the Sign Code in the event any portion is held to be unconstitutional or invalid.

 

RECOMMENDATION:                     For approval.
