Title
RESOLUTION - APPROVING THE INDEMNIFICATION AGREEMENT WITH HANLEX MARGATE, LLC FOR TAPPING OF A WATER MAIN, CONSTRUCTION OF A WATER SERVICE, AND RELOCATION OF A FIRE HYDRANT AT 700 SOUTH STATE ROAD 7.
BACKGROUND: The proposed water system construction by Hanlex Margate, LLC, the developer of the proposed Dollar General at 700 South State Road 7, will require connection to the City water main located in the FDOT right-of-way. FDOT permits work in their right-of-way by issuing a utility permit; however, FDOT utility permits are issued only to the utilities which own the facilities and not the private developer. As such, FDOT will issue a utility permit to the City as the permittee for the proposed work. The attached agreement indemnifies and holds the City harmless as the permittee and allows the private developer to work under the City permit until the proposed facilities are constructed and ownership transferred to the City.
