RESOLUTION APPROVING A SECOND AMENDMENT TO THE AGREEMENT WITH FRANK WEINBERG & BLACK, P.L. FOR LEGAL SERVICES RE: CITY CENTER DEVELOPMENT AGREEMENT
BACKGROUND:
On May 13, 2015 the Board approved an agreement with the law firm Frank, Weinberg and Black P.L. to represent the CRA in its negotiations with the selected developer of City Center. The agreement had a fee limit of $25,000. At the April 13, 2013 CRA Board meeting an amendment was approved increasing the fee limit to $38,000. That amendment was recommended by CRA staff, based upon a review with FWB attorneys of the fees that had been paid, as well as an assessment of potential future fees. Unfortunately subsequent to the Board’s action staff was informed by FWB that the assessment had not included some pending billings, which left less than $1,000 remaining in the amended agreement.
The Development Agreement will be ready for the June 8th CRA Board meeting. There are a few more modifications to make, and it is important that FWB be present at the board meeting to address any issues. It is recommended that an additional $5,000.00 be approved for completion of the Development Agreement, increasing the total amount of the legal services agreement with FWB to $43,000.
RECOMMENDATION:
Approve the second amendment to the agreement with Frank Weinberg and Black, increasing the maximum amount of legal fees to $43,000.
FISCAL IMPACT:
An additional $5,000 will potentially be charged to account #140-0510-512.31-01
