RATIFICATION OF AN AMENDMENT TO THE TEMPORARY USE AGREEMENT BETWEEN THE FRATERNAL ORDER OF POLICE LODGE #75 AND THE MARGATE COMMUNITY REDEVELOPMENT AGENCY

BACKGROUND:

On May 11, 2016 the CRA Board approved a Temporary Use Agreement between the Margate Community Redevelopment Agency and the Fraternal Order of Police Lodge 75, Inc. to hold a multi-day event to raise funds for a new marquee for Margate Elementary and local programs within the City of Margate. The organization requested the use of the CRA's property located at 1000 N. State Road 7 on Thursday, September 1st through Sunday, September 11th, 2016 (11 days) which included set-up and breakdown.

At the meeting of August 23, 2016 the CRA Board approved an extension of the time frame for the event, from Monday, August 29, 2016 through Wednesday, September 14, 2016 (17 days). Unfortunately due to storm conditions (lightning and flooding) they were unable to start setting up in time and lost several days. Per the attached letter from FOP President Amalin Guarino, an additional seven days' use of the property is being requested. If approved the last day of operations would be Sunday September 18th, and breakdown would be completed by the end of the day on Wednesday September 21st.

Margate Code of Ordinances 3.24 (B)(d) states "City administration may grant an event up to seven (7) additional calendar days of operation, due to unforeseen circumstances such as natural disturbances, but not including economic hardships." A request for an administrative extension has been submitted to the City Manager.

Due to the fact that under the current approved schedule, the carnival would have to be off of the property by the same date as the next CRA Board meeting (September 14th), the Chair signed off on the requested extension without full board approval. That approval will have to be ra...
