Title
APPROVAL OF AN ORDINANCE TO AMEND THE MARGATE ZONING CODE, ARTICLE III GENERAL PROVISIONS, SECTION 3.24 OUTDOOR EVENTS TO EXCLUDE FIREWORK OR SPARKLER SALES FROM THE EXCEPTIONS PROVIDED BY THE ORDINANCE.
BACKGROUND: The proposed ordinance amends Appendix A Zoning, Article III General Provisions, Section 3.24 Outdoor Events. The Zoning Code currently includes an exception that allows religious institutions or charitable organizations that are utilizing the same operator and location for an event that had previously received approval by the Development Review Committee (DRC) to petition for approval of subsequent events by submitting a written request to the Economic Development Department. If Economic Development staff determines that all requirements of the Code have been satisfied, the petitioner may proceed without reappearing before the DRC. The ordinance will provide an exception to exclude firework or sparkler sales. In other words, any event that includes firework or sparkler sales, regardless of whether previous DRC approval had been granted, will be required to reappear before DRC for approval.
The City Commission directed staff to draft this ordinance.
RECOMMENDATION: The Development Review Committee reviewed this ordinance at the DRC meeting on September 27, 2016, and approved it as to form, with no revisions recommended. A draft copy of the minutes is attached. Appearing before the Planning and Zoning Board on October 4, 2016, a motion to recommend approval of the ordinance failed with a 0-4 vote, thereby recommending against the proposed changes.
