AN ORDINANCE OF THE CITY OF MARGATE, FLORIDA, CREATING CHAPTER 2 ADMINISTRATION; ARTICLE I IN GENERAL; SECTION 20 PROHIBITION ON USE OF CITY LOGO AND SLOGAN; PROVIDING FOR REPEAL; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE.
BACKGROUND: Florida Statute Section 165.043 provides that a municipality may designate, by ordinance, an official municipal seal. The City of Margate designated an official seal by Ordinance 91-21. Florida Statute Section 165.043 further states that the manufacture, use, display, or other employment of any facsimile or reproduction of the municipal seal, except by municipal officials or employees in the performance of their official duties, without the express approval of the governing body, is a second degree misdemeanor.
Neither Florida Statutes or City Charter or Code, addresses the use of the City logo and slogan. This ordinance is to provide that no person or entity may use or display the City’s logo or slogan except the City, businesses directly affiliated with the City, and those entities having a sponsorship relationship with the City.
RECOMMENDATION: Approved at First Reading by the Margate City Commission on November 2, 2016.
