Title
NOTIFICATION FOR SPECIAL EXCEPTION AND VARIANCE REQUESTS.
BACKGROUND: Public notices are to be mailed to all properties adjacent to a site requesting a conditional use permit for the installation of a telecommunication tower as provided in Section 3.23.4(h) Notice of public notification of the Zoning Codes, which states “Notice of an application for a conditional use permit shall be sent via certified mail to all property owners within a one-hundred-foot radius of the affected property. The applicant shall pay a fee of two hundred fifty dollars ($250.00) as well as the cost of the certified mailing.”
On June 4, 2008, the Margate City Commission approved Ordinance 2008-07, which eliminated the mailing requirement for variance and special exception applications. Such applications require a public hearing sign to be placed on the subject property, as provided for in Section 39.4 (D) of the Zoning Code, but no longer require mailings.
This item is before Commission for discussion regarding mailing of public notices.
