Title
TO APPROVE AUTO USES AT 1690 BANKS ROAD AND 1700 BANKS ROAD.
BACKGROUND: In 2005, the property owner of 1690 and 1700 Banks Road petitioned to change the zoning designation from M-1A industrial park to M-1 light industrial. During the rezoning process, the property owner voluntarily offered to prohibit auto uses at 1690 and 1700 Banks Road in order to facilitate the rezoning.
On April 20, 2016, the City Commission considered a request of the petitioner to allow auto uses at the above properties; however, there was not a successful motion for further consideration. Subsequently, the petitioner requested to be placed on a meeting agenda in a quasi-judicial format so that he had an opportunity to be heard. On May 10, 2016, the City Commission denied, in a quasi-judicial hearing, the request of the property owner to allow auto uses at 1690 and 1700 Banks Road.
This resolution is to consider approval of auto uses at 1690 and 1700 Banks Road by not requiring the petitioner to adhere to his previous offer to prohibit auto uses at these properties.
RECOMMENDATION: For consideration by the City Commission.
