RESOLUTION- APPROVING AN INTER-LOCAL AGREEMENT (ILA) BETWEEN THE CITY OF MARGATE, BROWARD COUNTY, AND OTHER BROWARD COUNTY MUNICIPALITIES TO SHARE THE RESOURCE BURDEN OF THE SYSTEM-WIDE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY (EPA), NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) PERMIT.
BACKGROUND: This Agreement will allow the City of Margate to continue to share resources with Broward County and other participating Municipalities to implement the requirements of the NPDES MS4 Permit Program. The EPA, by way of the Water Quality Act of 1987, 33 U.S.C. 1251, and 40 CFR 122.42(c), requires the County and the Municipalities to comply with the applicable conditions of the NPDES MS4 Permit Program. The EPA has recommended that the Broward County act as "lead permittee" and the Municipalities act as "co-permittees.” Previous ILA’s for the program were executed on December 3, 1996, October 20, 1998, June 29, 2004, and May 7, 2013. The most recent ILA expired at the conclusion of the third five-year NPDES MS4 Permit on January 4, 2017. A new NPDES MS4 Permit covering the next five (5) years was issued on January 5, 2017.
