Title

CONSIDERATION OF AN ORDINANCE TO PROVIDE UPDATED REGULATIONS FOR WALKWAY CAFES.

Body

BACKGROUND: Currently walkway cafes less than 400 square feet are permitted as of right as an accessory use to a restaurant. Walkway cafes 400 square feet or larger are special exception uses, requiring City Commission approval. This ordinance proposes to increase the threshold for walkway cafes as permitted uses from 400 square feet to 1,000 square feet. As such, a walkway café less than 1,000 square feet will be permitted as of right and those 1,000 square feet or larger will require special exception approval from the City Commission. Furthermore, this ordinance proposes to permit televisions and outdoor music in the walkway café dining areas, and to eliminate the prohibition on pass thru and walk up windows.

RECOMMENDATION: This item was approved by the Development Review Committee (DRC) on

May 9, 2017. A signed copy of the meeting minutes is attached. The Planning and Zoning Board approved the proposed ordinance with a 5-0 vote at its meeting on June 6, 2017. A draft copy of the meeting minutes is attached.
