MEDICAL MARIJUANA DISPENSARIES

BACKGROUND: The State approved Senate Bill 8A on June 23, 2017. This bill preempts local governments, and provides specific limitations for how medical marijuana dispensaries are regulated. The bill gives municipalities the option of either banning dispensaries completely, or allowing dispensaries under the same regulations as pharmacies. The Margate Zoning Code currently allows pharmacies by right in all commercial and mixed use zoning districts. The City of Margate has enacted a moratorium on medical marijuana dispensaries that is due to expire November 17, 2017. Staff is looking for direction from the City Commission on this topic.
