MEDICAL MARIJUANA DISCUSSION

BACKGROUND:                     The State approved Senate Bill 8A on June 23, 2017.  This bill preempts local governments, and provides specific limitations for how medical marijuana dispensaries are regulated at the municipal level.  The bill gives municipalities the option of either banning dispensaries completely, or allowing dispensaries under the same regulations as pharmacies.  The Margate Zoning Code currently allows pharmacies by right in all commercial and mixed use zoning districts.  The City of Margate has enacted a moratorium on medical marijuana dispensaries that is due to expire April 6, 2018.  Staff is looking for direction from the City Commission on this topic.                                          

 

The City Attorney’s Office will be presenting an overview of the State law and regulations governing medical marijuana dispensaries, aka, treatment centers.

 

 

RECOMMENDATION:                     For discussion and Commission direction.
