BACKGROUND: The City of Margate has been in an interlocal agreement with the School Board of Broward County (SBBC), Broward County, and several Broward municipalities since 2003 in order to provide a voluntary school mitigation program to alleviate overcrowded public schools and create necessary classroom capacity.

In 2007, this agreement was amended to include a public school concurrency program. Public School Concurrency is a growth management tool to ensure that public school facilities are available to serve new development by the time that new development starts to place demand on infrastructure. The agreement required all new residential development to comply with development review criteria and established a level of service (LOS) standard for each SBBC public school to be 110% of permanent capacity of each school. Permanent capacity is calculated based on the number of seats available within a "brick and mortar" structure, portable classrooms are not counted for this level of service.

The Second Amended Interlocal Agreement for Public School Facility Planning was adopted in 2010 to modify the level of service standard from 110% of permanent capacity to 100% of gross capacity until the end of the 2018/19 school year. Gross capacity counts seats within portable classrooms in addition to traditional brick and mortar classrooms. The level of service standard would return to 110% permanent capacity starting in the 2019/20 school year.

The primary purpose of the Third Amended and Restated Interlocal Agreement for Public School Facility Planning (TRILA) that is before the City Commission tonight is to redefine the adopted level of service as the higher of 100% gross capacity or 110% permanent capacity.
