Title
CLARIFICATION OF A CONDITION OF APPROVAL FOR SPECIAL EXCEPTION USE TO PERMIT THE CONSTRUCTION OF A CUMBERLAND FARM GASOLINE SERVICE STATION AT 5485 WEST ATLANTIC BOULEVARD.
BACKGROUND: The City Commission approved a special exception use application on January 25, 2017 to permit the construction of a new Cumberland Farms gasoline service station at 5485 W. Atlantic Boulevard. Resolution 17-012 is the instrument which recorded the approval with all conditions of approval described therein. This special exception was approved subject to 21 enumerated conditions. Condition number 18, under Section 2 of the resolution reads, “Provide windows on the south façade of the building in the patio area.”
During the final site plan approval and building permit review process, the applicant has requested to install faux windows rather than standard windows due to conflicts with the internal usage of the building. During the quasi-judicial hearing on January 25, 2017, the applicant did not make clear the intention of installing faux windows. The applicant is before the City Commission to receive clarification on this condition of approval.
