Title
APPROVING AN AGREEMENT WITH JOHNSON, ANSELMO, MURDOCH, BURKE, ET. AL. FOR LEGAL SERVICES PERTAINING TO THE CITY CENTER PROJECT.
BACKGROUND: On Tuesday March 1, 2018, New Urban Communities, LLC filed a lawsuit in Broward County Circuit Court against the Margate Community Redevelopment Agency. The lawsuit has one count. The Plaintiff, New Urban, seeks specific performance of the Development Agreement. In essence, the relief sought by New Urban is to obtain a Court Order directing the Margate CRA to perform under the terms of the Development Agreement.
It is recommended that Michael Burke, Esquire of the law firm of Johnson, Anselmo, Murdoch Burke et. al, be retained to assist in the defense of the lawsuit filed against the Margate CRA by New Urban.
RECOMMENDATION: Approve.
FISCAL IMPACT: The Margate CRA will be billed for the actual time expended on the case at the rate of $200.00 per hour for the Firm’s attorneys and $90.00 per hour for the Firm’s paralegals. Funding is available in Professional Services-Legal (140-0510-512.31-01).
