Title
ORDINANCE TO REVISE WINDOW SIGN REGULATIONS AND PROVIDE FOR AMORTIZATION ON NON-CONFORMING SIGNS.
BACKGROUND: The attached ordinance is based on the discussion held at the August 23, 2017 City Commission workshop. Changes include the elimination of content based regulations, duplicate language, requiring a permit for permanent window signs, allowing additional design flexibility, and providing a six month amortization. After this item was tabled at the January 24, 2018 City Commission meeting, staff revised the draft ordinance to apply the restriction of non-transparent windows to all businesses, and updated the sign waiver criteria provided in Section 39.19 of the Margate Zoning Code. This item was tabled at the February 21, 2018 City Commission meeting in order to ensure consistency with architectural guidelines that are currently being considered. Suggested changes to the ordinance consisted of prohibiting “perforated vision wrap materials.” Staff included a sample analysis for Applebee’s Neighborhood Grill, located at 5377 W Atlantic Blvd, as requested by the City Commission.
RECOMMENDATION: The Development Review Committee (DRC) recommended approval at the DRC meeting on October 24, 2017. The Planning and Zoning Board recommended approval (3-1 vote) at the December 5, 2017 meeting. A draft copy of the meeting minutes is attached. This item was previously heard at the January 24, 2018 City Commission meeting, and was tabled to be heard at the February 21, 2018 Commission meeting with a 5-0 vote.
