RESOLUTION - PROVIDING AUTHORIZATION TO ENTER INTO AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF MARGATE AND THE MARGATE COMMUNITY REDEVELOPMENT AGENCY TO PROVIDE THAT THE MCRA SHALL REIMBURSE THE CITY OF MARGATE FOR COSTS TO REPAIR THE RETAINING WALL LOCATED AT 1225 AND 1229 EAST RIVER DRIVE.

BACKGROUND: At the April 11, 2018 CRA Board Meeting, the CRA Board directed CRA Staff to look into whether the CRA is able to expend funds for the repair of the impaired retaining wall located at 1225 and 1229 East River Drive. Based on this request, CRA Attorney Donald J. Doody provided a memorandum indicating that the CRA can fund in whole or in part the retaining wall restoration project at 1225 and 1229 East River Drive based on the language set forth in Part III, Section 1, Paragraph B, Goal 1, Subsection E of the Margate Community Redevelopment Plan.

The City of Margate has applied for a grant through the National Resource Conservation Service (NRCS) Emergency Watershed Protection Program. NRCS Staff conducted a Damage Survey Report and has deemed this retaining wall restoration project to be an eligible project under this program. The NRCS grant requires a 75%/25% cost share arrangement. Currently, the City is awaiting a determination of whether NRCS funding is available for this project. As a result, authorization is being requested by the CRA Board to enter into an interlocal agreement with the City for their approval to reimburse the City either for the amount equal to the 25% match provided for in the NRCS program or up to the full amount of the retaining wall restoration project if NRCS funding is not available for all or part of the project costs.

As an alternative to the foregoing, the CRA Board could consider funding all of the project based upon NRCS eligibility.
