RESCINDING MARGATE COMMUNITY REDEVELOPMENT AGENCY RESOLUTION NO. 618; APPROVING the LICENSE AGREEMENT BETWEEN THE CITY OF MARGATE AND THE MARGATE COMMUNITY REDEVELOPMENT AGENCY FOR THE TEMPORARY USE OF MARGATE COMMUNITY REDEVELOPMENT AGENCY PROPERTY

BACKGROUND:                     The MCRA Board adopted Resolution No., 618 at its December 10, 2019 meeting.  This resolution set out parameters and conditions by which the City could use MCRA owned land and provided a system of approval for the use of the land by simple notification and completion of a form.  Unfortunately, lines of communication between the CRA and City Attorney were somewhat muddled and additional changes needed to be made to the agreement.

 

The changes have been vetted and included in an amended agreement which is before the MCRA Board for approval.  None of the changes are a significant departure from the original agreement.  Changes have been made to allow a waiver of time requirements in instances of emergency, as well as to streamline public records issues and affirm liability limitations.

 

Included in the backup information to this item are Resolution No. 618, a copy of the Agreement that will replace the one previously approved, a marked up copy of the original agreement so that you may see the changes between the old and new agreements.

 

 

RECOMMENDATION:                     Approve the resolution rescinding Resolution 618 and approving the Agreement for use of CRA land by the City.

 

 

FISCAL IMPACT:                     There should be no fiscal impact to the CRA for use of land by the City
