ALCOHOLIC BEVERAGES; PROVIDING FOR HOURS OF OPERATION FOR ESTABLISHMENTS LICENSED TO SERVE OR SELL ALCOHOL; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND:                     

At the September 12, 2019 City Commission code workshop, there was discussion and consensus to amend the Zoning Code to restrict hours for establishments licensed to serve alcohol for consumption on the premises until 2am.  The attached ordinance removes the special permits for extended hours, and standardizes hours until 2 a.m. for establishments licensed to sell or serve alcohol for consumption on the premises.  While drafting this ordinance, staff did not propose any changes to the hours of package sales, which are currently permitted between 7 a.m. and 12 midnight. 

 

This item was heard on First Reading at the 12/4/2019 Regular City Commission meeting and was tabled (5-0) to the 1/22/2020 Regular City Commission meeting.  Revisions to the ordinance since it was tabled include:

 

1) Sunday morning hours were adjusted to start at 11:00 a.m.

 

2) Selected dates for 4 a.m. were included, as recommended by the Planning and Zoning Board.

 

3) Effective date of October 1, 2020.

 

This item was heard on First Reading at the 1/22/2020 Regular City Commission meeting and was approved 3-1.

 

 

RECOMMENDATION:                     The Planning & Zoning Board voted 4-1 on November 5, 2019 to recommend approval of this ordinance with the addition of six specified dates when alcohol service would be permitted until 4 a.m., and the ability of businesses to request additional dates for extended hours through the Temporary Use Permit (TUP) process.
