DISCUSSION AND POSSIBLE ACTION - SIGN CODE ENFORCEMENT

BACKGROUND: At the Commission meeting on October 21st, the Commission discussed sign code enforcement and issues related to a moratorium on enforcement. The discussion was tabled to the November 4th meeting and direction was given to Staff to identify possible solutions to the issues. The City Manager and City Attorney met and agree that the moratorium on enforcement is an “all or nothing” action. Per case law, we are unable to legislate based on the content of a sign.

 

Aside from the issues above, the City’s temporary sign code is outdated and requires updating. We have requested additional funding in a budget amendment so that we can include Section 39- Sign Code in this year’s phase of our comprehensive code rewrite.

 

Based on the above, we recommend the Commission formally set an end date to the sign code moratorium.
