A RESOLUTION OF THE CITY OF MARGATE, FLORIDA, APPROVING THE SECOND AMENDMENT TO AND RESTATEMENT OF THE TRANSPORTATION SYSTEM SURTAX INTERLOCAL AGREEMENT WITH BROWARD COUNTY, THE METROPOLITAN PLANNING ORGANIZATION, AND PARTICIPATING MUNICIPALITIES; PROVIDING FOR FISCAL YEAR 2019 AND FISCAL YEAR 2020 ALLOCATIONS; PROVIDING FOR CRITERIA FOR EVALUATION, RANKING, AND RECOMMENDING FUNDING OF PROJECTS IN FUTURE BROWARD COUNTY ANNUAL FIVE-YEAR CAPITAL IMPROVEMENT PLANS.

BACKGROUND:                                           

On June 5, 2018 the Broward County Board of County Commissioners enacted Broward County Ordinance No. 2018-29, the Broward County Surtax Ordinance, which, among other things, provides a process by which any municipality within Broward County may apply for project funding from surtax proceeds, which process includes a request that the Broward Metropolitan Planning Organization (MPO) review and rank all municipal projects based on each project's ability to alleviate traffic congestion and enhance connectivity; and funding of submitted municipal projects shall be accomplished through interlocal agreements between the County and the applicable Municipalities; and on August 21, 2018, the Broward County Board of Commissioners approved the Transportation System Surtax Interlocal Agreement (the "Agreement") that requests municipalities in the County to approve the Agreement; and pursuant to the Agreement, the County has committed for each applicable year during which Transportation Surtax Proceeds are received by the County, an amount equal to a minimum of ten percent (10%) of the Transportation Surtax Proceeds received by the County that year, less the amount directly paid from Transportation Surtax Proceeds for Community Bus Service, shall be used to fund Submitted Municipal Projects in the order of ranking by the MPO, with the highest-ranked project receiving the first funding; and on February 28, 2020, the MPO completed its review and ranking of municipal capital and rehabilitation and maintenance projects and provided its recommendations to prioritize funding for 110 municipal capital projects for the County's fiscal year ("FY") 2020; and on June 18, 2020, the County Commission approved Transportation Surtax funding for FY2020 (which included funding carried forward from FY2019) of more than $60 million for the applicable phases of the 97 statutorily-eligible municipal capital projects recommended by the MPO, and up to $50 million for municipal rehabilitation and maintenance projects; and in July 2020, in connection with the County's annual budget process and the County's FY2021 five-year capital improvement planning, the MPO provided its recommendations to fund additional phases of the 97 approved municipal capital projects; and on September 22, 2020, the County Commission approved more than $43 million in Transportation Surtax funding for community shuttle service and municipal capital projects for FY2021 and approved the FY2021 five-year capital plan; and given the extent of the amendments, the City Commission finds it in the best interest of the City to approve the Second Amendment to and Restatement of the Agreement.

 

 

 

RECOMMENDATION:                     

It is the recommended the City of Margate Commission approve the resolution.
