BACKGROUND: At the January 20, 2021 Regular City Commission meeting, the City Commission requested a Workshop to discuss Code Enforcement.                                           

 

The following is background on a few code sections that may be discussed by the City Commission.

 

PARKING ON GRASS:

The Code of the City of Margate does not specifically prohibit parking standard vehicles on grass at residential property. 

 

Section 33-69.52 Supplemental local regulations <https://library.municode.com/fl/margate/codes/code_of_ordinances?nodeId=PTIICOOR_CH33POLAENOFMIPR_ARTVITRCO_S33-69.52SULORE> of the Code of the City of Margate includes a number of parking regulations for both public and private properties.  This Section could easily be modified to address vehicles parked on grass at residential property. The regulatory authority for parking enforcement in within Section 33-70 Parking violations declared unlawful <https://library.municode.com/fl/margate/codes/code_of_ordinances?nodeId=PTIICOOR_CH33POLAENOFMIPR_ARTVITRCO_S33-70PAVIDEUN>.  Paragraph (1) of this section states, “This section shall apply to ordinances regulating parking on public or private property within the city.” These sections are located in Chapter 33 Police and Law Enforcement, because that is the department that would enforce parking violations.  Revision to this Chapter is not included in the scope for the CGA contract, so minor adjustments to parking standards should be able to parallel this project with minimal disruption to the Code Re-Write project schedule.

 

 

PARKING OF BOATS AND RV’s

Section 26-3 Parking regulations for noncommercial vehicles used for recreational purposes <https://library.municode.com/fl/margate/codes/code_of_ordinances?nodeId=PTIICOOR_CH26PANOVEUSREPUCOVE_ARTIINGE_S26-3PARENOVEUSREPU> of the Code of the City of Margate provides regulations for how and whether boats and RV’s may be parked at residential property.  If the City Commission is interested in changing the size or number of recreational vehicles, or where/how they may be parked, or whether screening materials are required, this would be the appropriate Section to make those changes.   Again, revision to this Chapter is not included in the scope for the CGA contract, so it should be able to parallel this project with minimal disruption to the schedule.

 

Section 3.9 <https://library.municode.com/fl/margate/codes/code_of_ordinances?nodeId=PTIICOOR_APZO_ARTIIIGEPR_S3.9PRRE> of the Margate Zoning Code provides that boats, tents, trailers, campers shall not be maintained for sleeping or living purposes or as a place of residence.  This is a different nature of regulation from those regulations intended to address whether a boat would have to be parking behind a fence or hedge.  Appendix A is included in the scope for the CGA contract, so modifications to this Section (in the Zoning Code) create a potential to affect the timing
