APPROVING THE LICENSE AGREEMENT FOR DEBRIS STAGING BETWEEN THE CITY OF MARGATE AND THE MARGATE COMMUNITY REDEVELOPMENT AGENCY FOR THE TEMPORARY USE OF MARGATE COMMUNITY REDEVELOPMENT AGENCY PROPERTY

BACKGROUND:                     A License Agreement between the City of Margate and the MCRA was initially approved by the MCRA Board via resolution 609 on September 24, 2019 for debris staging through December 31, 2019. The License Agreement was updated and approved via resolution 640 on May 13, 2020, and effective through December 31, 2020. 

 

The purpose of this item is to approve a similar License Agreement prior to the upcoming 2021 hurricane season.

 

The License Agreement allows for the use of two vacant MCRA-owned properties by the City of Margate for temporary debris staging:

-                     Parcel 1: located on the east side of State Road 7 and Margate Boulevard

-                     Parcel 2: located at the northwest intersection of State Road 7 and Margate Boulevard

 

The Agreement allows for Parcel 1 to be used by the City as the primary staging site and used for vegetation only. Parcel 2 is to be used as a secondary site for the City to stage construction and demolition debris on the concreted areas with vegetative debris allowed on the grassy areas of the parcel.

 

The reason for the separation in staging is to ensure no debris is placed on either parcel in a method that could be environmentally detrimental so as to not violate any provisions of the current Developer Agreement between the MCRA and New Urban Communities.

 

The Agreement is designed so there is no liability on the part of the MCRA and that the City will return the property to its pre-use condition if it is required for debris staging.

 

 

RECOMMENDATION:                     Approval of the License Agreement through December 31, 2021.
