BACKGROUND: Since the dissolution of the Resource Recovery System in 2013, there has been an absence of an entity to oversee countywide solid waste disposal and recycling processing. As such, Broward County and the 31 municipalities came together to form the Solid Waste Working Group (SWWG) to work collaboratively to address such issues and potentially form a new countywide solid waste disposal and recycling authority. The SWWG is comprised of eight municipal representatives and one Broward County representative as well as a Technical Advisory Committee (TAC), which is comprised of staff from the County and each municipality. Over the last two years, the SWWG has been working to determine the best form of governance for this new countywide solid waste and recycling authority and, at its March 1st meeting, the SWWG voted 6-3 to recommend to seek legislative formation of an independent special district to govern solid waste disposal and recycling issues countywide. The other governance options considered by the SWWG were the formation of a dependent special district or a long-term collaboration through an interlocal agreement.

For reference, the following are the definitions of the three governance options considered:
* Independent Special District - a special district whose formation requires an act of the Florida State legislature to establish the purpose of the special district as well the governing rules and structure.
* Dependent Special District - The Resource Recovery System used this form of governance. A special district that is dependent on the county or one municipality. A dependent special district must meet at least one of the following criteria:
