BACKGROUND:                     

 

On April 3rd2019, the Commission approved a Resolution (# 19-036) to grant a 10-foot, wide easement on property located at 5510 West Copans Road and owned by Culvers of Margate LLC. The purpose of the easement was to allow the City of Margate to maintain and operate a 6” Ductile Iron (DI) water main, service lines and appurtenances that were in the easement. The original easement consisted of a service connection, but the as built location of this service connection varied from the design location, which precipitated this resolution. This resolution therefore seeks to modify the original easement to accommodate the as built location of the installed service line.

 

The draft resolution 2021-200 that seeks to ratify the utility easement is in Backup Document A attached.

 

This easement will add an L-shaped section with an area of 396.48 square feet to the original easement. The L-shaped easement is shown in red in Background Document B (Utility Easement Deed), attached.

 

Also attached in Background Document C is the associated Bill of Sale for the requested easement. 

 

 

RECOMMENDATION:

                     

Approve the easement.
