APPROVING THE LICENSE AGREEMENT BETWEEN THE CITY OF MARGATE AND THE MARGATE COMMUNITY REDEVELOPMENT AGENCY FOR THE OPERATION, MAINTENANCE, AND MANAGEMENT OF THE COVERED ATHLETIC FIELD PROPERTY; AUTHORIZING THE CHAIR AND THE EXECUTIVE DIRECTOR TO EXECUTE THE LICENSE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE

BACKGROUND: The Certificate of Occupancy for the Covered Athletic Field project was issued on September 16, 2021. The new covered open-air, multi-purpose facility provides many opportunities for sporting events, community gatherings, special events, and other public events sponsored by the City, the MCRA, and third parties.
MCRA staff recommends that the operations, maintenance, and management of the Covered Athletic Field facility be handled by the City's Parks and Recreation Department. This would minimize scheduling conflicts and create a consistent and efficient process for the use of facilities in the City.
The MCRA will retain ownership of the property and provide for insurance coverage. The City will be responsible for the routine maintenance and repair of the property at no cost to the MCRA; however, the City may request the MCRA pay for certain costs associates with maintenance and repair upon request to and approval by the Executive Director (# 6 in attached agreement). In addition, rental/use fees collected by the City on behalf of the MCRA for use of the property would be provided to the MCRA pursuant to a formula adopted by the Parks and Recreation Department and the MCRA Executive Director (#4.3).
