CONSIDERATION OF AN ORDINANCE TO ELIMINATE OR MODIFY MINIMUM SEPARATION REQUIREMENTS FOR ESTABLISHMENTS LICENSED TO SERVE OR SELL ALCOHOL.

BACKGROUND:                     During the regular City Commission meeting held on August 28, 2019, the City Commission discussed current zoning laws regarding separation requirements for establishments licensed to serve or sell alcohol.  At the City Commission Code Workshop held on September 12, 2019, the Commission directed staff with a 3-2 vote to present options to the City Commission pertaining to the alcohol separation laws with supportive research.  Staff has attached a Code Comparison spreadsheet and a copy of applicable Code for the cities of Boca Raton, Coconut Creek, Coral Springs, Delray Beach, Miramar, Pembroke Pines, and Pompano Beach.  One ordinance was written to eliminate all separation requirements for establishments licensed to serve or sell alcohol.  A second ordinance was prepared to modify the current regulations to exempt duly licensed restaurants, change the distance requirements, and change the way separations are measured.  A third option would be to maintain the current zoning laws which require a 1,000ft separation measured by a specified walking route.
